Gerindra ‘Confident’ MK Rejects Lawsuit for Presidential Candidates’ Age Limit of 70 Years News – 19 minutes ago

Jakarta, CNBC Indonesia – The Gerindra Party is optimistic that the Constitutional Court will reject the lawsuit in Case Number 102/PUU-XXI/2023 and Case Number 104/PUU-XXI/2023. The two lawsuits asked the Constitutional Court to set a maximum age limit for presidential candidates, namely 70 years and 65 years.

“We are optimistic because we see that the Constitutional Court Judge’s considerations in the cawapres lawsuit are less than 40 years old,” said Gerindra Party DPP Daily Chair Sufmi Dasco Ahmad on the sidelines of the Gerindra National Meeting at The Darmawangsa Jakarta, Monday (23/10/2023).

Dasco’s lawsuit against the vice presidential candidate less than 40 years old refers to the lawsuit filed by the Indonesian Solidarity Party. In its lawsuit, PSI asked the Constitutional Court to change the minimum age limit for presidential and vice presidential candidates to 35 years. The MK rejected the lawsuit.

Dasco said that one of the reasons the Constitutional Court rejected the lawsuit was because the Constitution does not regulate the age limit for presidential and vice-presidential candidates.

The Constitutional Court, he said, considers that the age limit for presidential and vice presidential candidates is within the authority of law makers or open legal policy.

He believes that the Constitutional Court will again use these considerations to reject the lawsuit regarding the maximum age limit for presidential candidates being 70 years. “The lawsuit regarding the upper limit being the same as the lower limit will not be accepted by the Constitutional Court,” he said.

The lawsuit regarding the upper age limit is of concern to Gerindra, because the general chairman of Gerindra and the presidential candidate supported by the Forward Indonesia Coalition, Prabowo Subianto, is 72 years old. If the lawsuit is granted, Prabowo will certainly not be able to compete in the 2024 Presidential Election.

The Constitutional Court is scheduled to read out two lawsuits regarding the maximum age limit for presidential candidates today in a trial starting at 10.00 WIB. Lawsuit 102/PUU-XXI/2023 was filed by Wiwit Ariyanto, Rahayu Fatika Sari, and Rio Saputro. They asked the Constitutional Court to set the minimum age of 40 and 70 years as the maximum age limit for presidential and vice presidential candidates.

In their petition, they also asked the Constitutional Court to change Article 169 of the Election Law. The three of them asked the Constitutional Court to require that presidential and vice-presidential candidates never be involved in cases of serious human rights violations.
